Q. When can I ask for an increase in child support?
A. Child support can be modified any time you can demonstrate a change of circumstances, such as:

  • A pay raise by the noncustodial parent
  • Increased needs or expenses of the child

Q. Can I get my child support reduced if I've lost my job?
A. Job loss is the most common reason for child support to be reduced, but you must request a reduction from the court and obtain an order reducing child support.

Q. When can I seek a modification of custody?
A. Two years after the last custody order, you must be able to show a change of circumstances. Prior to the lapse of two years, you must prove that both the physical or mental health of your child is endangered.

    Child Custody and Visitation Challenges
    Removing a Child from Illinois:
    A parent cannot move away from the state with a child without the consent of the other parent or an order from the court. The court will usually grant an order if the parent can prove the move will result in improved financial livelihood; but remarriage in and of itself is usually not sufficient. The other parent can fight the removal in court. We represent people seeking to move out of state, as well as people opposing such a move.

    Custody Issues with a Gay or Lesbian Parent:
    We are seeing an increasing number of custody cases involving gay or lesbian parents. Courts do not discriminate against parents because of sexual orientation; however, if the sexual orientation of a parent affects the child, it can be considered by the court.
