Legal Malpractice

Bringing a Legal Malpractice Claim in Illinois

Q. What is Legal Malpractice?

A. In order to qualify as legal malpractice, an attorney must fail to live up to basic standards of legal care, and that negligence must result in financial or other actual loss to the client. Some examples of legal malpractice include:

  • Failing to file or prepare required paperwork
  • Missing a deadline for filing court papers or taxes
  • Overcharging a client or charging something different than the agreed upon fee
  • Failure to uncover significant facts of a case that should have been uncovered as a matter of course

Q. What is NOT Legal Malpractice?

A. If you have suffered no loss due to your attorney's misconduct, you cannot bring a legal malpractice claim. You also cannot bring a claim if:

  • The misconduct was from an opposing attorney, not your own
  • You were treated rudely
  • If you were simply unhappy with the result of your case

Your court case went badly. In an adversarial process like the U.S. court system, sometimes that happens. The facts and the law favored one side over the other.

But what if the facts and the law favored you and still you lost? You may suspect — you may know — it was something that your lawyer did or did not do that turned the case against you.

You may have a claim for legal malpractice.

For more than 30 years, attorney William Allison has been representing individuals and businesses who've suffered financial damage because of legal malpractice. He serves clients in Sangamon County, Champaign County, Macon County and Peoria County, Illinois, and brings legal malpractice claims in the areas of:

  • Business law
  • Personal injury and wrongful death
  • Family law
  • Criminal defense
  • Estate planning

Did your attorney fail to file required papers? Did he or she miss a court date? These are two of the most common mistakes for which clients bring cases of legal malpractice, but there are many others that can qualify as legal malpractice.
